Terms and conditions

Version 16 October 2026 · My AI B.V.

This is an English translation, provided for your convenience. The Dutch version is legally binding: if the two differ, the Dutch text prevails.

These terms and conditions apply to the use of My Notetaker. Some rules apply only to business customers and others only to consumers; where that is the case, this is stated. For business use, the data processing agreement forms part of these terms and conditions.

1. Definitions

2. Applicability

  1. These terms apply to every use of My Notetaker and every agreement with us relating to it. The terms and conditions of a business customer do not apply.
  2. You accept these terms when you create your account. You can always view, save and print them on this page.
  3. If a provision is void or annulled, the other provisions remain in force. We will then replace the provision with a valid one that comes as close as possible to its intent.

3. Account

  1. You must be 18 years of age or older to create an account.
  2. When signing up, you indicate whether you use My Notetaker for business or private purposes. State this truthfully: it determines which rules in these terms apply to you. If you choose business, you declare that you are acting for the purposes of your trade or business.
  3. You keep your password secret and are responsible for what happens with your account. If you suspect misuse, change your password immediately and let us know.
  4. An account is personal. If your account is paid for by an organisation, it nevertheless remains your account: your conversations remain yours, even if you leave the organisation.

4. The service

  1. With My Notetaker you record conversations and have them automatically transcribed, summarised and analysed. You can search your conversations and ask questions about them. Which features you have depends on your plan as described on our website and in the app.
  2. AI can make mistakes. Transcripts, summaries, action items, sentiment analyses, contact profiles and answers are created by AI. They may be inaccurate or incomplete; in the case of silence or poor audio, the AI may even make up text. Always check important information in the transcript or the recording before relying on it.
  3. Not a medical device and not advice. My Notetaker is a tool for recording and retrieving conversations. It is not a medical device, does not make diagnoses, does not give treatment advice and does not give legal, financial or other professional advice. You make decisions about people yourself.
  4. We provide the service with the care that may be expected of a good service provider. This is a best-efforts obligation: we do not guarantee that the service will always work without interruption or errors.
  5. We may improve and change the service. If a feature that is an essential part of your paid plan is removed, Article 17 applies.

5. Trial period, prices and payment

  1. A new account receives a free trial period of 14 days with the features of the Team plan. You do not need to provide any payment details for this, and the trial ends automatically. The trial can be used once per person and per email address, even if you delete your account and create it again. If you do not choose a subscription, you can no longer record or ask questions afterwards, but your conversations remain readable, downloadable and deletable.
  2. If you choose a subscription during the trial, you keep the features of the trial until the trial ends. Your chosen plan then takes effect and the first payment follows.
  3. The current prices are shown on our website and in the app, per user per month, both including and excluding 21% VAT. Consumers pay the price including VAT. Business customers in another EU country with a valid VAT number pay excluding VAT (VAT reverse-charged).
  4. Subscriptions are paid in advance, per month or per year, via our payment service Stripe (including by credit card or iDEAL). The price is per user: the number of users in your organisation determines the amount. If users are added or removed, the amount is adjusted pro rata.
  5. Each plan has a maximum number of recording minutes per month. You can see in the app how much you have used this month.
  6. You can find invoices in the app under Settings > Subscription and in the Stripe customer portal. If a payment fails, you will be given the opportunity to update your payment details. If payment is still not made, we may suspend the service as described in Article 16.

6. Term, renewal and cancellation

  1. Monthly subscription: runs per month and renews automatically every month. You can cancel at any time, effective from the end of the current month.
  2. Annual subscription: runs for a fixed term in the first year.
    • Business customers: the subscription renews automatically for one year at a time, unless you cancel before the end of the current year.
    • Consumers: after the first year, the subscription continues for an indefinite period. You can then cancel it at any time with a notice period of one month. We will refund the part of the prepaid annual price that remains after the notice period within 14 days.
  3. You cancel yourself in the app (Settings > Subscription > Manage subscription) or by sending an email to info@my-ai.nl. You will receive a confirmation. Cancelling is just as easy as signing up.
  4. After the subscription ends, your account continues to exist without a subscription (see Article 5.1). You can also delete your account; a current subscription of which you are the only user then ends immediately, without a refund for the current period (unless Article 6.2 or 7 provides otherwise).

7. Right of withdrawal (consumers)

  1. As a consumer, you can withdraw from a subscription within 14 days of taking it out, without giving any reason.
  2. You do this with the Withdraw the agreement here button in the app (Settings > Subscription), with the model form or with another clear statement to info@my-ai.nl.
  3. After withdrawal, your subscription ends immediately and we will refund everything you have paid for the subscription within 14 days, using the same payment method. We do not charge any costs for the period in which you were already using the service. Your account and conversations continue to exist until you delete them yourself.
  4. You will receive a confirmation of your withdrawal.

8. Rules of use

  1. Inform the people you talk to. You tell the people you speak with that you are recording the conversation and for what purpose, and you ask for consent where required. This also applies when phone calls are recorded automatically with your watch.
  2. Only record conversations in which you yourself take part. It is prohibited (and a criminal offence under Articles 139a to 139c inclusive of the Dutch Criminal Code (Wetboek van Strafrecht)) to use My Notetaker to record a conversation in which you do not take part, for example by having a device record in a room where you are not present.
  3. Comply with the law and with your professional rules. You are yourself responsible for lawful use, including under the GDPR, your duty of confidentiality (such as medical professional secrecy or the legal professional privilege of lawyers) and the rules of your professional group. Business customers ensure a valid legal basis, carry out a DPIA where necessary and inform the people they talk to and their employees.
  4. No assessment of employees by AI. You do not use My Notetaker to assess, monitor or select employees or job applicants, and you do not base decisions on recruitment, assessment, promotion or dismissal on output from My Notetaker such as the sentiment analysis. My Notetaker is not designed for this.
  5. You do not use My Notetaker for emergencies or for applications in which a malfunction or error may lead to injury or harm to persons.
  6. You do not use My Notetaker to store or distribute illegal content, to infringe the rights of others, or to disrupt, circumvent, test for vulnerabilities without our permission, or copy the service.
  7. You do not share your account with others. Every user has their own account.

9. Your content and our property

  1. Your content remains yours (or the customer's, if the customer has made other arrangements with you about this). An organisation cannot view the content of its members.
  2. You give us permission to process your content only to the extent necessary to provide the service to you. We do not use your content to train AI models, nor for marketing, and we do not sell it.
  3. The software, design and trademarks of My Notetaker belong to us or our licensors. You receive a personal, non-transferable right to use My Notetaker for as long as your account exists and you comply with these terms.

10. Privacy and data processing agreement

  1. How we handle personal data is set out in our privacy statement.
  2. For business use, we process conversation content as a processor on behalf of the customer. Our data processing agreement applies to this, which the customer accepts by accepting these terms.

11. Notices of illegal content and point of contact

  1. My Notetaker stores content that is visible only to the user themselves. We do not look at it and do not moderate content in advance.
  2. If you believe that illegal content is stored in My Notetaker, report this via info@my-ai.nl with: an explanation of why you believe the content is illegal, information that is as precise as possible for locating the content, your name and email address (unless the matter concerns child sexual abuse) and a statement that your notice is accurate and complete to the best of your knowledge and belief. We will confirm receipt, assess the notice carefully and let you know what we do with it.
  3. If we remove content or restrict or suspend an account, we will let the user concerned know why and how he or she can object to this, unless the law or a competent authority prohibits this. If we suspect a criminal offence that threatens the life or safety of persons, we will report this to the competent authorities.
  4. Our single point of contact for users and for authorities within the meaning of the Digital Services Act (Digitaledienstenverordening) (Articles 11 and 12 DSA) is info@my-ai.nl. You can write to us in Dutch or English.

12. Exporting data and switching

  1. You can download all your data yourself at any time in a commonly used, machine-readable format (JSON) via Settings > Privacy. The export contains your account details and, per conversation, the metadata, title, transcript, summary and analysis. You can download the original audio per conversation, insofar as your plan allows this.
  2. If you want to switch to another service or retrieve your data into your own systems, you can cancel your subscription as set out in Article 6 (the notice period is never longer than two months). After the end of your subscription, you can still export your data for at least 30 days; your account remains available for this purpose. If we need technical assistance from you, or you from us, we will cooperate to a reasonable extent. Switching and exporting are free of charge.
  3. If you delete your account, we permanently erase your data, as described in the privacy statement.

13. Availability and maintenance

  1. We strive to keep My Notetaker available at all times. We carry out planned maintenance outside office hours as far as possible.
  2. Recordings are sent to us in small pieces during recording and, if the connection is interrupted, are kept on your device until they can be sent. Nevertheless, we cannot rule out that a recording is lost due to a malfunction of your device, your connection or our service. For conversations where a record is indispensable, also keep your own backup or notes.

14. Liability

  1. Business customers: our liability for damage caused by a failure to perform or a tort is limited to direct damage and to no more than the amount the customer paid for My Notetaker in the twelve months before the event causing the damage. We are not liable for indirect damage, such as consequential damage, lost profits, missed savings, loss of data or damage due to business interruption. A claim lapses if it has not been reported to us in writing within twelve months after the customer knew or could have known of the damage.
  2. Consumers: we are liable in accordance with the law. The limitations in paragraph 1 do not apply to consumers.
  3. The limitations do not apply in the event of intent or deliberate recklessness on the part of us or our management, nor to damage resulting from death or injury.
  4. We are not liable for damage caused by your relying on AI output without checking it (Article 4.2), or by your breaching these terms or the law. A business customer indemnifies us against claims by third parties, including the people they talk to, arising from use contrary to Article 8.

15. Force majeure

We are not liable if we cannot fulfil our obligations due to force majeure, such as a malfunction at a supplier or in the internet, a power outage, a cyber attack that we could not reasonably have prevented, or a government measure. If the force majeure lasts longer than 30 days, either party may terminate the agreement; we will then refund the prepaid amount for the remaining period.

16. Suspension and termination by us

  1. We may restrict or suspend your access, or terminate the agreement, if you breach these terms seriously or repeatedly, if payment is not made after a reminder, or if the law or a competent authority requires this. We do so in proportion to the breach, let you know why and, where reasonable, first give you the opportunity to remedy the situation.
  2. Even if we restrict your access, you can still export your data, unless the law or a competent authority prevents this.
  3. We may discontinue the service as a whole with at least three months' notice. We will refund prepaid amounts for the period after that, and you can export your data until the end.

17. Changes to the service, prices and terms

  1. We may change these terms and our prices. We will notify you of a change that is disadvantageous to you at least 30 days in advance in the app and by email. A price change only takes effect from the next billing period.
  2. If you do not agree with a disadvantageous change, you can cancel your subscription with effect from the date on which the change takes effect. Consumers will then receive a refund of the prepaid amount for the remaining period.
  3. Changes that are required by a change in the law, or that are solely to your advantage, may take effect immediately.
  4. In the event of a change to these terms or the data processing agreement, we will ask you to agree again in the app.

18. Complaints

If you have a complaint about My Notetaker, email info@my-ai.nl with a clear description. We will confirm receipt within 3 working days and give a substantive response within 14 days. If we need more time, we will let you know within those 14 days, with an indication of when you will receive a response.

19. Applicable law and disputes

  1. Dutch law applies to these terms and all agreements with us.
  2. Disputes with business customers will be submitted to the competent court of the District Court of Overijssel (Rechtbank Overijssel).
  3. Consumers may submit a dispute to the court that has jurisdiction under the law, including the court of their place of residence. A consumer who lives in another EU country retains the protection of the mandatory rules of that country.
